The only witness whose testimony related directly to the assault, Mary Rittenhouse, had her general moral character seriously impeached, but the trial judge instructed the jury that though this impeachment of her character was serious they might exercise their discretion and accept parts of her testimony whilst rejecting other parts. Jim was convicted and sentenced to death, and appealed. The Supreme Court ruled that the established law was that if a witness was suspected of being unsound in respect of any part of their testimony then the jury was obliged to reject all their testimony. A new trial was ordered.
