The plaintiff kept a firearm disguised as a cane in her yard. The defendant's slave, a boy around fourteen years old, on the request of the plaintiff's servant went into the plaintiff's yard and picked up the gun, which for all appearances looked like a cane. The gun fired off and killed the plaintiff's slave. The plaintiff sued for damages. The suit was denied on the grounds that the plaintiff's negligence had caused the accident. Judgment affirmed in favour of the defendant.
