At the seizure Cherry pointed a pistol at the constable and said If you do not turn that negro loose I will shoot you. The constable stood his ground, and Cherry lowered the pistol and went away. Cherry's counsel contended that as the pistol had not been loaded, he was not guilty. The court charged the jury that if the facts as given were correct then Cherry was guilty of an assault. The Supreme Court found that the state had no obligation in bringing its prosecution to prove that the pistol was loaded, and anyway that Cherry, by presenting the pistol as loaded, had no right to complain that such was prima facie taken to be the case. Judgment affirmed.
