|a The plaintiff showed title to the premises through descent from Malachi Dozier. Dower had been assigned to his widow including the building involved in this case. The widow had then re-married to the defendant. He took possession of the premises and continued to live there until the death of his wife. He had removed a small poultry house worth [dollars] 5. The dwelling house was in bad condition and had not been repaired. The kitchens were allowed to decay into a terrible state, but it was contended that much of the damage was due to natural causes. The stables and quarter kitchen were in a better condition than when the defendant first took possession. Despite this, it was argued by the plaintiff that the entire value of the property was adversely affected. Jury gave a verdict for the plaintiff, but Judge Saunders set this aside. Judgment reversed. The Supreme Court ruled that the count for permissive waste could not be sustained, but that the action for voluntary waste was valid and the defendant should not have removed the poultry house. The reference to a quarter kitchen on the premises in this case suggests the presence of slaves.
