He offered to prove by witnesses that he and other slaves had had consensual sexual contact with Rogers on previous occasions, but this was rejected by the court. The court did accept, as evidence for the prosecution, a confession that Jefferson was alleged to have made after his arrest. He was found guilty and sentenced to death, and appealed to the Supreme Court. This found nothing in the judgment to which to take exception.
