Summary:Action for breach of a contract of hiring. Defendant employed the slave at a fishery contrary to the hire agreement, which said that the slave should not be employed at a fishery or on water, but there was no evidence of any actual damage done. Witnesses giving evidence for both sides. Dispute as to whether a verbal statement was given that the slave could be employed at a fishery or on water at the risk of the hirer in variance to the paper documents. It was held that the plaintiff or his agent could make this alteration. There being no damage and no breach of the amended terms, the plaintiff could not recover.
