|a The defendant was charged, as a free person of color, with carrying a shotgun. Defence counsel tried to show that he was a free white person. Statute forbidding carrying arms specified free negroes. The Revised Code chapter 107, section 79 stated that a person had to have less than one-sixteenth part of negro blood before ceasing to be a free negro. The act as specified in Revised Code chapter 107, section 66 was confined to free negroes. The Supreme Court arrested the judgment against the defendant as the indictment had used the words free person of color which could include those of Indian blood instead of the words free negro.
