|
|a Piver, a boy of 13 or 14, was indicted for the murder of a slave. Having met the slave in the road, Piver, who was carrying a gun, threatened to shoot him if he did not move out of his way. The slave walked on, Piver crossed the road to block his way, and the slave pushed Piver over. Piver then shot the slave dead. The court determined that Piver's killing of the slave under these circumstances was manslaughter. Since statute determined that no punishment was attached to the manslaughter of a slave, he walked free.
