|a The plaintiff, sister of the late Robert Caldwell, claimed ownership of slave called Nancy and the money owed for her hires from the defendant. She said that her brother had loaned her [dollars] 300 in 1836 and she allowed him to keep possesssion of the slave until she repaid the loan. He then agreed to pay reasonable hire services for keeping the slave at [dollars] 100 per year. She therefore claimed [dollars] 1,100 for 11 years of hire fees less the [dollars] 300 loaned. Her own witness, Logan, gave a slightly different story. The plaintiff had sold Nancy to Isaac Flynn, who had then become dissatisfied with the title of the slave. Robert Caldwell purchased the slave back from Flynn in Missouri on behalf of his sister. Under Missouri law he thus owned the slave and this remained the case when the slave was brought back to Louisiana. Robert Caldwell had said that her slaves made little profit for his sister and that she would do well to let him take them all to Louisiana and hire them out for work there. The defendant was the testator of Robert Caldwell. He based his claime on the fact that the slave had been purchased by Caldwell in Missouri in 1836. Judgement of the court below for the defendant was affirmed.
