Instead the court instructed the sheriff to hire him out until his labour had paid for the costs, against which order Hood appealed. The Supreme Court found that the act of 1787 under which Hood was to be hired out had been repealed by an act of 1797 which authorised those in his position to take the oath of insolvency. Judgment reversed.
