|a Hood, a free black man, was convicted of assault and battery and required to pay the costs of his prosecution. Being unable to do this, he prayed to be discharged on taking the oath required for insolvent debtors. Instead the court instructed the sheriff to hire him out until his labour had paid for the costs, against which order Hood appealed. The Supreme Court found that the act of 1787 under which Hood was to be hired out had been repealed by an act of 1797 which authorised those in his position to take the oath of insolvency. Judgment reversed.
