The remainder of Martin's property was bequeathed to Giles Mitchell, whom the will also appointed guardian of the four slaves. This bill was filed by Martin's next of kin and prayed that the slaves and other property detailed in the voided clause be distributed to the heirs-at-law. Mitchell set up a demurrer to the bill on the grounds that the property should go to him as Martin's residuary legatee; this demurrer was sustained by the judge and the next of kin appealed. The Supreme Court affirmed that property that failed to pass in a legacy that had been declared void passed instead to the residuary legatee.
