Summary:The plaintiff petitioned for a divorce on the grounds that before his marriage his wife had had a child whom she represented as his, but that after the marriage he discovered the child was mixed-race. The judge dismissed the petition and the plaintiff appealed to the Supreme Court. The Supreme Court reversed the verdict and granted the divorce as a concession to the deep-rooted and virtuous prejudices of the community upon this subject, though Justice Ruffin dissented on the grounds of disbelief that the plaintiff had been either unable to ascertain the colour of the baby by sight or that, alternatively, he had shown no interest in seeing a child he believed to be his own.
