520 |a Dispute between two tenants in common. The defendant's testator was in sole possession of some 500 acres. Some 400 acres were good land, the rest was a swamp with little or no timber. Some 150 acres was good forest which the defendant's testator cut down in its entirety and then put this land into cultivation. No timber was left for repairing fences or for other maintenance. He declared his purpose to be to wear out the land and remove his slaves to the south-west. He subsequently moved as stated and it was then proved that he had done permanent damage to the sale value of the land and had greatly impaired its use. Verdict for plaintiff in the lower court was reversed by the Supreme Court. New trial ordered. Dispute as to the definition of waste and legal methods open to the co-tenant. Clearing woodland to put land into cultivation could be deemed to be prudent management.
