|a Howell was charged with the murder of Henderson Floyd. Both were men of color who lived with their families in the same house. A quarrel took place about who should have the house, and Howell declared that he would whip Floyd. Floyd walked away from the house but Howell pursued him and stabbed him, from which he died. The court instructed the jury that if Howell had pursued Floyd with a knife then he was guilty of murder. Howell was found guilty and he appealed. The Supreme Court upheld the verdict.
