|a Action for payment of a [dollars] 400 promissory note for the hire of a slave called Monroe, a blacksmith, for the year 1853. The defendant pleaded that the agreement had been that if Monroe should die during the period of hire then the plaintiff should only be paid for the time he lived, and that he did die after about two months. The court found for Brooks for the sum of [dollars] 72.32 plus the costs of the suit, from which he appealed. The Supreme Court upheld the judgment.
