520 |a In 1828 the sheriff of Franklin county had in his hands five writs of fieri facias, one in favour of the State Bank and one in favour of Richard Yarborough. All were against Thomas Yarborough; two were against him and another party. The sheriff also had a writ in favour of Nathan Perry which was returned as having been levied upon a colt. The sheriff subsequently levied on the writ in favour of the bank and accordingly seized a number of slaves from Thomas Yarborough, who were sold for [dollars] 615. The sheriff spent several days in pursuit of them. The court ruled that the money raised from this sale should be applied exclusively to the satisfaction of the writ in favour of the State Bank, whilst the [dollars] 25 raised from the sale of the colt should be applied to the satisfaction of the writ in favour of Richard Yarborough. From this judgment the plaintiffs appealed to the Superior Court. This reversed this judgment, ordering that the [dollars] 615 go first to Richard Yarborough and then the balance to Nathan Perry, and any remainder after that to the holders of the other writs ratably. From this the directors of the State Bank appealed to the Supreme Court. This discussed the use of indemnities by the sheriff and reversed the judgment again, ordering that the [dollars] 615 go to the State Bank and the [dollars] 25 to Richard Yarborough.
