Summary:The sheriff of Houston county levied on a debt on a mortgage owed by Alexander Lee and sold George, a slave mentioned in the mortgage agreement, for [dollars] 1,500. The levy had been in favour of McNair but the sheriff refused to pay over the proceeds on being told that they were also claimed by Bateman and Talton, who were the assignees of an older execution issued against Lee. The Inferior Court assigned the proceeds to McNair but this was reversed and the proceeds assigned to Bateman and Talton by the Superior Court on appeal, whereupon McNair appealed to the Supreme Court. This affirmed the Superior Court's judgment.
