The defendant was sentenced to death by hanging. Whilst it was argued that the deceased had attacked and threatened the prisoner, the latter had still taken steps to seek out and kill McGuire. The testimony of John Grady revealed that the prisoner had tried to borrow a bowie knife from him; another witness said that they had seen the two men fighting on board the steamboat Atlantic. This witness, James Hawthorn, a thief and an unreliable character, said that he later heard a pistol shot and saw the prisoner escape from the boat across the levee.
