Three of these children, however, were known by Archer to be dead at the time the will was drawn up. The will also directed that Archer's slave Bob be emancipated at Archer's wife's death or remarriage and that he enjoy the use and profits of ten acres of land. The question before the court was how the legacies directed towards the dead children were to be distributed. The court determined that Archer had died intestate in respect of the three tenths of his estate directed towards his deceased children and directed that this legacy go to his heirs-at-law.
