|a A bill filed by the complainants to obtain from James possession of a certain property on the grounds that the will of Thomas Tudor, under which James claimed, was void. The bill claimed that Tudor's intention in giving property to one Tillery was to emancipate some slaves, which was then illegal under Georgian law. James demurred to the bill for want of jurisdiction. The court sustained the demurrer and the complainants appealed. The Supreme Court ruled that the power to award or rescind a will's probate lay exclusively with the court of ordinary and upheld the Superior Court's verdict.
